Terms of Service

1. These terms

Daily Duel is made by SudoBloom, LLC, a Kansas limited liability company ("we", "us"). These terms cover the website at dailyduel.app and the Daily Duel app for Android (together, "Daily Duel"). By using Daily Duel you agree to them. Our Privacy Policy and Refund Policy are part of these terms.

2. What Daily Duel is

Every night, two AI models argue a motion in front of an audience, AI judges score it, and the result plays out as an arcade fight. The audience votes on what gets argued and who argues it.

• Sides are assigned. Each model argues the side the card gave it. Nothing a fighter says is the opinion of the company that makes that model, or of us.
• Not affiliated. Model names appear only to say which model is fighting. Daily Duel is not affiliated with, endorsed by or sponsored by any of those companies. Their names and marks belong to them.
• It can be wrong. Fights, scores and calls are generated by AI and may be inaccurate, unfair or odd. Nothing in Daily Duel is advice of any kind.
• It changes. We may change, add or remove features, including how voting, coins and scoring work, and we may skip a night.

3. Who can use it

You must be at least 13 to use Daily Duel. If you are under the age of adulthood where you live, you need a parent or guardian's permission to make a purchase.

4. Your account

You sign in with your email address. Keep access to that email secure, because anyone who can read it can sign in as you. One person, one account: accounts made to get extra votes or welcome coins may be removed. You can delete your account at any time on the YOU tab.

5. Coins

• Coins are a game currency. 1 coin is 1 vote for a motion or a model on the ballot. You earn coins by playing, premium members receive coins each month, and you can buy them.
• Coins have no cash value. They cannot be exchanged for money, withdrawn, sold, or transferred to another account, and we never buy them back. They are a license to use a game feature, not property or a deposit.
• Coins you buy do not expire while your account is open. Coins are lost when an account is deleted or closed.
• Earning pauses while your balance is at or above the earning limit, as the RULES screen explains.
• We may change what coins do and how they are earned. If we ever shut Daily Duel down, we will give at least 30 days' notice.
• Coins that were credited by mistake, by a bug, or through a refunded or disputed payment may be removed.

6. Premium membership

• Premium costs $2.99 a month or $24.99 a year, plus tax where it applies. It includes: no ads, a vote that counts double, up to 5 motions a day, and 150 coins every month.
• It renews automatically at the end of each period and charges the same payment method until you cancel. Cancel from the STORE tab with "Manage membership". You keep premium until the end of the period you paid for.
• If we change the price, we will tell you at least 30 days before it applies to you, and you can cancel before then.
• We may change what premium includes. If we take something significant away, you may cancel and ask for a refund of the unused part of your period.

7. Paying

Purchases on the website are sold through Link, Stripe's checkout service, which acts as the seller of record. Link's own terms, shown at checkout, also apply to the payment. Purchases in the Android app are made through Google Play under Google's terms. Refunds are covered in the Refund Policy.

8. Motions you write

Premium members can write motions. When you do:

• It is public. It may appear on the ballot, be argued in a fight, be shown in the archive, and appear in clips and posts about Daily Duel.
• You keep whatever rights you have in it, and you give us a worldwide, royalty-free, permanent license to use, edit, display and share it, and to have AI models argue it, as part of running and promoting Daily Duel. Deleting your account removes your name from it but not the motion.
• An automated screen checks every motion, and we may tidy the wording, refuse it or remove it at any time.

Do not write motions that:

• name or target a private person, or include anyone's personal information;
• are hateful, harassing, sexual, violent, or encourage harm or anything illegal;
• ask for personal advice, such as whether to leave a partner;
• are about contested political or moral questions, such as elections, abortion, guns, immigration or religion. These make great arguments, but the fighters carry real companies' names, so we do not stage them.
• copy someone else's work, or use another company's name to suggest it endorses something.

9. Fair play

Do not use bots, scripts or multiple accounts to vote, earn coins or make picks; break or probe our security; get around limits or the store; scrape the service in bulk; or use Daily Duel in a way that breaks the law. We may remove votes, coins or motions gained this way, and suspend or close the accounts involved.

10. Our content

The Daily Duel name, the characters, stages, artwork, sounds and software belong to us. You may share links, screenshots and clips of fights for non-commercial purposes, as long as you do not suggest a model's maker holds the view its fighter argued. The app shows that disclaimer on the fight itself; please leave it in.

11. Ending things

You can stop using Daily Duel and delete your account at any time. We may suspend or close an account that breaks these terms, and we will tell you why unless the law or safety prevents it. If we close your account without a good reason under these terms, we will refund any unused premium time and coins you bought and did not spend.

12. No guarantees

Daily Duel is provided "as is" and "as available". To the extent the law allows, we make no promises that it will always be available, free of errors, or that fights and scores are accurate. Some places do not allow these exclusions, so they apply to you only as far as the law allows.

13. Limit on liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim about Daily Duel is limited to the greater of what you paid us in the 12 months before the claim or US $50. This does not limit liability that cannot be limited by law.

14. Law and disputes

These terms are governed by the laws of the State of Kansas, USA, without regard to its conflict of law rules. Please write to us first; most problems are solved by an email. Any court case goes to the state or federal courts in Sedgwick County, Kansas. If you are a consumer in the EU or UK, you keep the protection of the laws where you live and can bring a claim in your local courts.

15. Changes to these terms

We may update these terms. We will change the date at the top, and if a change matters, tell you in the app or by email before it takes effect. If you keep using Daily Duel after that, the new terms apply. If you do not agree, you can cancel and delete your account.
